2. Trademark, Copyright and Restrictions
Artiserrie owns the sole property rights to all material owned, operated, licensed or controlled by Artiserrie, including text, graphics, icons, audio, electronic downloads, data and software. This material may not be copied, reproduced or forwarded for commercial purposes without the express prior written consent of Artiserrie.
i. Any person who uses any of the websites owned by the Artiserrie, or the content contained therein, for illegal activities or fraud will be subject to civil and/or legal prosecution.
ii. It is illegal to place orders under a false name, with a fraudulently obtained credit card or without the consent of the cardholder. Persons found to have placed a fraudulent order will be prosecuted.
4. Customer Security and Privacy
i. By using any websites that are owned or operated by Artiserrie, you are acknowledging that we may collect and use some of your personal information. The data collected by Artiserrie is strictly limited and will only be used for the purposes of completing order transactions and improving the customer experience.
ii. Artiserrie may share customer’s information with third parties as necessary for the purposes of completing the order.
iii. Artiserrie will not disclose customer’s personal information to third parties for commercial purposes.
iv. Customers may wish to remain anonymous and send flowers anonymously and may do so. However, information about the giver may be required to complete electronic transactions and therefore must be disclosed in certain circumstances.
5. Promotional Materials
i. Artiserrie will, from time to time, contact customers via email, fax or post to distribute the latest product information and details of promotions.
6. Pricing and Transactions
i. With the exception of large orders, for which we may offer a special discount, prices are as per those quoted on the website.
ii. All product prices are quoted in Malaysian Ringgit.
iii. All published prices do not include shipping, delivery or transportation costs. These will be detailed during the final checkout process or within the settlement bill.
iv. In the event that a customer requires a refund, such a refund can only be made to the PayPal or credit card account that was used to purchase the item. Due to security reasons, Artiserrie will not refund cash or cheques to customers, nor will the funds be transferred to third party accounts.
While Artiserrie does make every effort possible to deliver products that look exactly like those featured on the website, some items are limited. Seasonal and under-supplied products may be replaced with a substitute. We reserve the right to use products of an equal or greater value as part of the order. We also ensure that the quality of the substituted item matches the quality of the ordered item. For instance, we may send pink roses in the event of a red rose shortage.
8. Discount Terms
i. All discounted product prices do not include shipping and delivery costs; please refer to the local freight table.
ii. All online discounts and product promotions cannot be used in conjunction with any other discounts or gift vouchers.
iii. Product discounts will be applied during the discount period only. Discounts will not be applied to any order after payment has been taken and customers must apply the discount before finalization of the payment.
iv. Discount terms apply in conjunction with any other terms outlined in this agreement or within the terms of each individual discount.
9. Delivery Conditions
i.Artiserrie will display the full product price, delivery cost and total payment required before checkout.
ii. Customers who do not opt for same day delivery of products can select their preferred delivery time. However, 24 hours’ advanced notice is required. Under normal circumstances same day deliveries will be made between 9:00 A.M. and 12:00 P.M. In the event that traffic conditions or any other accidents delay delivery, the Company’s customer service representative will contact the customer.
iii. In the event of delivery delays or omissions, Artiserrie will not be held responsible for failed delivery due to the following:
a. The recipient is not available to accept delivery at the specified delivery address within the specified delivery period.
b. The delivery address is incorrect.
c. There is insufficient information about the recipient to complete the delivery.
d. The contact telephone number of the recipient is incorrect or invalid.
iv. If the requested flower must be delivered within a specified period of time or within a narrow time frame, customers should contact Customer Support on 017-8409463 at least 24 hours in advance. We reserve the right to turn down requests if the delivery resources are not available to meet special requests.
v. Delivery time specification – Specific requests for delivery times require a minimum of 24 hours’ notice prior to delivery. If the notice is received less than 24 hours prior to delivery, we will endeavour to fulfil the request but cannot guarantee that this will be possible. If such a request requires an additional transportation fee, this will be billed to the customer. For delivery enquiries, please contact our customer service hotline on 017-8409463.
vi. If products are not delivered as a result of the recipient’s unavailability or due to inaccurate delivery information, the purchaser will be required to meet all additional delivery charges.
Artiserrie is unable to guarantee that the flowers will retain their exquisite quality. In some cases, we may be required to repackage items. If this is the case, a charge of no more than 70% of the order’s total will be implemented. Any products including perishable products that are undelivered due to weather or traffic conditions will be redelivered to the same delivery location within 24 hours free of charge.
vii. A delivery surcharge will be applicable for any redirection of orders.
viii. Artiserrie do not offer free delivery.
ix. The existing service area of Artiserrie is limited to the territory of Kota Kinabalu. However, we will soon expand our business to different regions and cities to meet the needs of customers beyond the Sabah, Malaysia borders.
10. Complaints Policy
Due to the fact that the items we delivery are perishable, we are unable to refund orders once they have been delivered. If you wish to make a complaint about any of the items you have received, please get in touch with our Customer Service department within 24 hours of receipt. Our representatives are passionate about working with you to resolve your complaint and ensure that you are happy. If you reach out to us on a holiday or while the office is closed, one of our representatives will get in touch with you by the next business day.
If you do make a complaint about the product you receive, Artiserrie has the right to request a photo of the product you received. We may also request to retain the original product as part of our investigation process.
11. Cancellation Policy
At some point, you may wish to cancel an order. If this is the case, we ask that you give us at least 48 hours’ notice prior to delivery time. If we receive your cancellation request within 48 hours of delivery time, we reserve the right to charge you RM60 as part of administrative fees. In the case that we have already purchase packaging materials and flowers, we may be unable to cancel your order. This is also the case if the package has already been delivered. You will be required to pay the full value of the purchase.
To cancel an order, customers should call the Customer Services hotline on 017-8409463 providing details of the order number, As per the Pricing and Transaction Policy (6), refunds will only be made to the PayPal or credit card from which the original payment was made.
12. Alteration & Amendments Of Orders
i. The amendment of orders requires at least 48 hours prior to delivery.
ii. In the event that the value of any replacement goods is lower than the value of the original product, the difference in value will not be refunded in cash, via PayPal or through credit card.
We are unable to provide any alterations or amendments for orders that are in the process of being prepared, already prepared and/or in transit.
iii. Depending upon the alteration or amendments the Customer must pay for any additional fees and charges incurred.
iv. In the event that the value of any replacement goods is lower than the value of the original product, the difference in value will not be refunded.
v.Artiserrie reserves the right to refuse order adjustment or amendments.
vi. Returns and Refunds: Flowers are perishable and natural. For this reason, Artiserrie is unable to accept refunds or returns. If you are unsatisfied with the flowers you have received, we encourage you to get in touch with our Customer Service hotline. We will deal with each case individually.
13. Flower Quality
While Artiserrie is dedicated to sending flowers of excellent quality, flowers are perishable items. We hope that each gift we send will bring a smile to the recipient’s face. The life span of natural flowers may be affected by a number of conditions – where they are kept, how they are taken care of and how they are handled. In order to ensure that your flowers live for as long as possible, you should give the stems a beveled tail cut. Recipients should also replace the flowers’ water every other day, keep them out of direct sunlight and prevent them from overheating.
Because flowers, leaves and foliage are natural products, the way they look will differ depending on the season, environment and current weather. The product images used on Artiserrie are for reference only. We try to ensure that flowers are of high quality and resemble the photos, but this is not a guarantee.
Limitation of Liability:
To the fullest extent permitted by law, and notwithstanding anything contained herein, Artiserrie, is limited in liability to:
i. In relation to goods, the replacement of the goods, the supply of equivalent goods, the payment of the cost of replacing or repairing the goods or the payment of the cost of obtaining equivalent goods; and
ii. In relation to services, the supplying of the services again or the payment of the cost of having the services supplied again.
Artiserrie makes no warranty that this website, any information or ideas contained on this website or any products or services will meet your requirements. It is intended that this limitation applies to any and all liability or cause of action however alleged or arising unless otherwise prohibited by law.
By using this website you acknowledge that you cannot seek loss of profits, revenue or contracts from Artiserrie for any direct, indirect, incidental, special, consequential or exemplary damages arising out of purchases from our site.
